These Terms of Service (the "Terms") govern your access to and use of GoBoardcast, including goboardcast.com, our applications, software, AI features, recording tools, and related services (collectively, the "Services").

By creating an account, purchasing a plan, or otherwise accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. The Services

GoBoardcast provides tools that may allow users to create, edit, record, generate, organize, and export whiteboards, diagrams, scripts, presentations, audio, video, and related content. Features may include AI-assisted generation, camera and microphone recording, screen capture, local or cloud project storage, and media export.

We may add, remove, modify, limit, or discontinue features as the Services evolve. Specific features may be subject to additional terms, usage limits, technical requirements, or fees disclosed in the product.

2. Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement to use the Services. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization, and "you" includes the organization.

You may not use the Services if applicable law prohibits you from receiving or using them.

3. Accounts and Security

You may need an account to use some features. You agree to:

You may use a supported third-party login provider. Your use of that provider remains subject to its terms and privacy policy.

We may require account verification, security checks, or additional information when reasonably necessary to protect the Services, comply with law, or prevent fraud.

4. User Content

"User Content" means content you submit, create, upload, import, record, generate, store, or transmit through the Services, including prompts, text, whiteboards, drawings, files, images, audio, video, scripts, and project data.

4.1 Ownership

As between you and GoBoardcast, you retain the rights you hold in your User Content. These Terms do not transfer ownership of your User Content to us.

4.2 License to operate the Services

You grant GoBoardcast a worldwide, non-exclusive, limited, royalty-free license to host, store, reproduce, transmit, display, adapt, and otherwise process User Content only as reasonably necessary to:

This license ends when the relevant User Content is deleted from active systems, except for limited retention in backups, legal records, security logs, or where content has been shared with others.

4.3 Your responsibilities

5. Recording and Consent

You are solely responsible for complying with laws concerning recording, surveillance, privacy, publicity, employment, intellectual property, and consent.

Before recording a person, conversation, meeting, screen, presentation, or private environment, you must provide any required notice and obtain all legally necessary permissions. GoBoardcast does not determine whether recording is lawful in your jurisdiction or situation.

You must not use recording features to secretly monitor, impersonate, harass, exploit, or invade the privacy of others.

6. AI Features and Outputs

The Services may use artificial intelligence to generate or transform content. You acknowledge that:

GoBoardcast does not provide legal, medical, financial, accounting, educational-certification, or other regulated professional advice. AI outputs must not be treated as a substitute for qualified professional judgment.

Subject to applicable law and third-party rights, you may use outputs generated for you. GoBoardcast does not guarantee ownership, exclusivity, non-infringement, or registrability of any output.

7. Acceptable Use

You may not use the Services to:

  1. Violate any law, regulation, court order, sanctions restriction, or third-party right;
  2. Create, upload, distribute, or promote unlawful, fraudulent, defamatory, abusive, threatening, exploitative, or harassing material;
  3. Infringe copyright, trademark, privacy, publicity, trade-secret, or other rights;
  4. Record people or private communications without legally required notice or consent;
  5. Create or distribute sexual exploitation content, especially content involving minors;
  6. Facilitate violence, terrorism, human trafficking, fraud, phishing, malware, credential theft, or unauthorized surveillance;
  7. Impersonate another person or misrepresent the source, authenticity, or endorsement of content;
  8. Attempt to gain unauthorized access to accounts, systems, networks, or data;
  9. Introduce malware, harmful code, or excessive automated traffic;
  10. Scrape, crawl, copy, resell, sublicense, or commercially exploit the Services except as expressly permitted;
  11. Reverse engineer, decompile, bypass, disable, or interfere with security, usage limits, or technical protections, except where law expressly permits;
  12. Use the Services to build or improve a competing model or service through systematic extraction of outputs, interfaces, or underlying components;
  13. Abuse free trials, credits, referrals, refunds, or payment systems;
  14. Use the Services in a manner that imposes unreasonable load or harms other users.

We may investigate suspected violations and remove content, restrict features, suspend accounts, or terminate access when reasonably necessary.

7.1 Adult, NSFW, and Sexually Explicit Content

You may not use GoBoardcast to create, request, upload, publish, distribute, promote, or otherwise facilitate any adult, pornographic, NSFW, sexually explicit, sexually suggestive, or sexually exploitative content.

This prohibition includes, without limitation:

GoBoardcast reserves the right to block content, restrict access, suspend accounts, or permanently terminate accounts that violate this policy.

8. Intellectual Property

The Services, including software, source code, user interfaces, designs, documentation, branding, trademarks, logos, templates, and non-user content, are owned by GoBoardcast or its licensors and are protected by intellectual-property laws.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal or internal business purposes during the term of your account or subscription.

No rights are granted except as expressly stated. "GoBoardcast," associated logos, and product names may not be used without permission.

9. Feedback

If you submit suggestions, ideas, or feedback, you grant us a perpetual, irrevocable, worldwide, royalty-free right to use them without restriction or compensation, provided we do not publicly identify you without permission.

10. Paid Plans, Credits, and Billing

Some features require payment, a subscription, or usage credits.

10.1 Prices and taxes

Prices, included usage, and billing intervals are shown at purchase. Prices may exclude applicable taxes, duties, bank fees, or currency-conversion charges. You are responsible for applicable charges unless law requires otherwise.

10.2 Subscriptions and automatic renewal

Unless stated otherwise at checkout, subscriptions automatically renew for the same billing period until canceled. You authorize the payment provider to charge the applicable renewal amount using your selected payment method.

You may cancel through available account controls or by contacting support. Cancellation prevents future renewal but does not normally produce a refund for the current billing period. Access remains available until the paid period ends unless otherwise stated.

10.3 Credits and usage limits

Credits, quotas, recording limits, storage limits, export limits, or other usage allowances may expire, reset, or vary by plan. Unless required by law or expressly stated, unused credits have no cash value, are not transferable, and are not redeemable for cash.

We may apply reasonable rate limits and fair-use controls to protect service quality and prevent abuse.

10.4 Payment failures

If payment fails, we may retry the charge, suspend paid features, downgrade the account, or terminate the subscription. You remain responsible for amounts properly due.

10.5 Price changes

We may change prices or plan features. For existing subscriptions, material changes will take effect no earlier than the next renewal after reasonable notice, unless a change is required by law, taxes, payment providers, or urgent security needs.

11. Refunds

Refund eligibility is governed by the separate GoBoardcast Refund Policy and mandatory consumer law. To request a refund, contact support@goboardcast.com.

12. Third-Party Services

The Services may rely on or integrate with third-party services, including authentication, AI models, hosting, storage, analytics, email delivery, payment processing, or content services.

We are not responsible for third-party services, their availability, content, security, or practices. Your use of a third-party service may be subject to separate terms. We may replace, discontinue, or change integrations at any time.

13. Privacy

Our Privacy Policy explains how we handle personal information. By using the Services, you acknowledge that policy.

14. Copyright and Rights Complaints

If you believe content available through the Services infringes your rights, send a detailed notice to support@goboardcast.com including:

We may remove or restrict content and may terminate repeat infringers where appropriate.

15. Suspension and Termination

You may stop using the Services at any time. You may request account deletion subject to our Privacy Policy.

We may suspend, restrict, or terminate access if:

Where reasonable, we will provide notice and an opportunity to remedy the issue. We may act immediately in urgent or serious cases.

Upon termination, your right to use the Services ends. Provisions that by their nature should survive—including ownership, payment obligations, disclaimers, liability limits, indemnity, and dispute terms—will survive.

16. Service Availability and Changes

The Services may experience interruptions, delays, errors, data loss, maintenance, or changes. We do not guarantee uninterrupted availability, permanent storage, compatibility with every device, or continued availability of any feature.

You are responsible for maintaining independent backups of important User Content and exported files.

17. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." GoBoardcast DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AVAILABILITY, AND RESULTS.

WE DO NOT WARRANT THAT THE SERVICES OR AI OUTPUTS WILL BE ERROR-FREE, SECURE, COMPLETE, UNIQUE, OR SUITABLE FOR YOUR PURPOSE; THAT DATA WILL NEVER BE LOST; OR THAT DEFECTS WILL BE CORRECTED.

Nothing in these Terms excludes warranties or rights that cannot legally be excluded.

18. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GoBoardcast AND ITS AFFILIATES, OWNERS, EMPLOYEES, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, BUSINESS, GOODWILL, DATA, CONTENT, OR OPPORTUNITY, ARISING FROM OR RELATED TO THE SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID GoBoardcast FOR THE SERVICES DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY; OR (B) USD $100.

These limitations apply regardless of the legal theory and even if a remedy fails of its essential purpose. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

To the extent permitted by law, you agree to defend, indemnify, and hold harmless GoBoardcast and its affiliates, owners, employees, contractors, licensors, and service providers from claims, liabilities, damages, judgments, losses, and reasonable costs arising from:

This obligation does not apply to the extent a claim results from GoBoardcast's own unlawful conduct.

20. Governing Law and Disputes

Unless mandatory consumer law provides otherwise, these Terms and disputes relating to them are governed by the laws applicable to the operator of GoBoardcast, without regard to conflict-of-laws principles.

Before filing a formal claim, you agree to contact support@goboardcast.com and attempt to resolve the dispute informally for at least 30 days. Nothing in this section prevents either party from seeking urgent injunctive relief or using a court or procedure that cannot legally be waived.

Mandatory consumer rights and local jurisdiction rules remain unaffected.

21. Changes to These Terms

We may update these Terms to reflect changes in law, the Services, pricing, security, or business operations. We will post the revised Terms and update the "Last updated" date. For material changes, we may provide additional notice where required.

If you continue using the Services after revised Terms take effect, you agree to the updated Terms. If you do not agree, you must stop using the Services and cancel any subscription before the next renewal.
